State Legislative Session Begins

January 13th marks the opening day for the Sixty-Seventh General Assembly for the State of Colorado.  This is also Brothers Clapham and Eulberg first session  as the lobbyists for the CPFF. There are several issues that impact fire fighters this session. CLICK HEADLINE TO READ THE BILLS.

 


FPPA

 

HB 10-1016, concerning the extension of the term of the retired member of the Board of Directors of the Fire and Police Pension Association.  This bill would extend the term of the retired firefighter or police officer service as a member of the board of directors from 4 to 6 years.

SB 10-022, concerning a member-approved increase in the member contribution rate to the statewide defined benefit plan administered by FPPA.    This bill permits the FPPA Board to increase the member contribution rate for the plan if the increase does not require an increase in the employer contribution rate or affect the plans status under federal law; and is approved by a supermajority of active plan members and a majority of the employers.

SB 10-023, concerning the discretion of the Board of Directors of FPPA to adopt rules regarding the return to work by a member participating in the Defined Benefit System of the association who elects retirement.  This bill allows the FPPA Board discretion to suspend the distribution of benefits to any retired member participating in the plan who, after electing to retire, has returned to work with another employer who participates in the plan.

 SB 10-024, concerning the repeal of the authority of the Board of Directors of the FPPA to affiliate with a local money purchase plan.

 

Pinnacol / WorkerÕs  Compensation

 

SB 10-11, concerning measures to reduce conflicts of interest in workerÕs compensation cases.  These measures deal with physicians who may have any business employment, financial, or other relationship creating a conflict of interest be available to the party upon request.  Furthermore, this has provision for timely claims processing and restrictions on communications between physicians, employers, and insurers unless it is in writing and provided to the injured party.

SB 10-012, concerning  increased penalties for violations of the workerÕs compensation laws.  Increase from $ 500 to $ 1,000 the penalty for violation.

SB 10-013, concerning the accountability for workerÕs compensation insurers.  This deals with surveys provided to workerÕs covering their claim handling and the reporting of those results to the Governor and members of the General Assembly.

HB 10-1009, concerning the Board of Directors of Pinnacol Assurance.  This changes the makeup of the board, the per diem rate, and a reasonable time for public comment at board meetings.

HB 10-1012, concerning limitations on the use of surveillance of employees who have submitted a WorkerÕs Compensation claim.

HB 10-1038, concerning a brochure to describe the process for WorkerÕs Compensation claims.  This will help to ensure the claimant will have the information relating to their rights and the process of filing.

 

Fire Districts

 

HB 10-1095 concerning a limitation on the authority of a fire protection district to charge fees for providing certain rescue services to those services provided at the scene of a motor vehicle accident.
